Court contempt: Kwara PDP chairman, others to appear before court today

The Kwara state high court has summoned the Chairman of Peoples Democratic Party(PDP), Chief Iyiola Akogun Oyedepo to appear before it today, to defend himself over contempt of court charge against him.

The Claimant, Alhaji Toyin Olosasa, who instituted the charge in court in suit number KWS\342\2014 also joined the PDP, Alhaji Adamu Mu’azu, Prof Olawale Oladapo and Amuda Yusuf Olugbon as first, second, third and fifth defendants on the matter.According to the notice obtained by our correspondent dated 8-9-2014, the claimant had applied to the court for an order to commit Oyedepo to prison, for having disobeyed the order of the court enjoining and restraining him from swearing in the 5th defendants as party chairman of Ilorin-West local government.

The claimant said that the fourth defendant did not obey the court order, determination of the motion on notice already filed by the claimant.

The defendants are to appear before the court to defend themselves on  why the bailiff of the court served him court notice on September  ,2014, ignored and neglected its order and went ahead to swear in the 5th  defendant.

The applicant, through his counsel, Magaji Oba Abdulkadir, in his written address with eleven paragraphs, asked the court to imprison the fourth defendant for court contempt pending the time he will purge himself of the said contempt.

The claimant counsel cited case of Kadiri vs Kadiri(1990)5 Nigeria Weekly Law Report(Pt 153) 665 to buttress his argument, stressing that there is clear evidence before the court that the fourth defendant disobeyed court order.

“Therefore, we humbly submit that the law is not a respecter of anybody except those that obey the law, since the contempt has not purged himself of the contempt of this court by reversing the steps he

took contrary to the order of this court.

“He must be imprisoned, until such time he is no longer in contempt. We urge the court to grant this application”, the claimant’s counsel added.
