Anti-grazing law: Court fixes Nov. 2 for hearing of Miyetti Allah’s suit against govt

The Federal High Court in Abuja has fixed November 2, 2017 for hearing of a suit filed by Miyetti Allah Kautal Hore, a Fulani socio-cultural association, seeking to stop Benue state government from outlawing open grazing in the state.
Recall that the Association had instituted the legal action, barely a week after the enactment of anti grazing law in Benue state.
In particular, the suit filed at federal high court Abuja with no FHC/ABJ/CS/527/2017 was instituted by Trustees of Miyeittii Allah Kautal Hore socio cultural association, Alhaji Abdullahi Bello Bodojo and Engineer Salleh Alhassan through their counsel, Aliyu Ahmed and associates.
Also, joined in the suit are the National Assembly, Attorney General of Federation, Inspector General of Police, Benue State house of Assembly, Benue State Government and Benue Commissioner of Police.
However, the matter which was earlier scheduled for hearing last week, was subsequently adjourned to the new date, following an application for time to study the made before the court.
The presiding Judge, Hon Justice Quadri Kabir, explained that the adjournment of the hearing of the case, was to enable all parties to the suit formalise necessary applications and processes.
Speaking with newsmen after the ruling, Counsel to the Benue state government, Barrister Terlumum Azoom said that all parties involved in the case have asked for time to regularise their applications, which the court obliged them.
He added that both defendants and the plaintiff, including those seeking the approval of the court to join in the suit are expected to make necessary submissions on the slated date for proper hearing of the matter.
Similarly, Counsel to Miyetti Allah Kautal Hore (the plaintiff), Barrister Ahmed Aliyu, explained that there was no objection to the ruling, as it was a fair decision on a unanimous prayer of all parties to the suit.
According to him, the plaintiff had instituted the suit against the Benue state government, and joined the Attorney General of the Federation and Inspector-General of police as co-defendants respectively.
PeoplesDaily reports that the Court was filled up with executives and members of Miyetti Allah Kautal Hore from across the 36 states, including Federal Capital Territory (FCT), who were had come to observe the proceedings there.
