Kaduna court of Appeal sitting in Barnawa has granted right of appeal in the case of demolition of Kaduna State University chapel brought by Reverend John Joseph Hayab against Mr. Isma’il Umaru Dikko the former Director General of the Kaduna State Urban Development Authority.
The plaintiff through his counsel Barrister Gloria Mabiem Ballason had moved a motion on notice seeking the leave of the court to file the appeal.
The court heard that in February 2023 the appellant Reverend John Joseph Hayab and one other took the respondent Mallam Isma’il Umaru Dikko to the Kaduna State Magistrate Court on charges ranging from Demolition of KASU Chapel, Criminal Trespass, Intimidation, Assault and Causing disappearance of Evidence.
The Plaintiff was however dissatisfied with the decision of the Chief Magitrate Court Taiwo Road Kaduna for rulling against the weight of evidence and therefore filed an appeal giving ten grounds as reasons for the appeal to be heard.
At the sitting at Barnawa, the Judge, Justice R. A. Oladoja and Justice Y. Badamasi therefore granted the appellant’s prayers seeking the leave of the court to file the appeal and argument for the appeal in the case.
