Man in court over alleged illegal demolition of houses

Mr. Garuba Kuamkur of Monitoring and Evaluation Unit, Department of Development Control, Federal Capital Territory (FCT), Abuja has been sued for alleged illegal demolition of four (4) residential buildings on Plot 47, Dutse Cadestran zone, Abuja.
Mr. Kuamkur had appeared for the 1st time in 2013 to lay claim to the plot of Land, but failed to make available the paper with which he claim to have acquired the land.
When the plaintiffs insisted he made available his title paper, Mr. Kuamkur disappeared till last year (2017) that he reappeared with renewed threat of demolition should the people fail to settle him with Ten Million Naira.
Mr., Kuamkur allegedly carried out his threat by completely demolishing all the 4 residential buildings on 31st August, 2017, since the plaintiffs could not pay him the money he demanded.
In all negotiations between the parties, Mr., Kuamkur would only want the money raised in draft without any legal agreement that would show he collected such money.
Mr., Kuamkur had also claimed that he acquired the land during the administration of Mallam Nasir el-Rufai as minister of the FCT.
Whereas the complainants acquired the land since 1995 and all structures on the plot were erected over 15years ago.
At the resumed hearing, Counsel to the plaintiffs, Barr., C. A Ogedengbe Esq., prayed the Court for an adjournment to enable him come formal so as to serve the 4th deffendant Mr., Garuba Kuamkur by subsituted means.
Barr. Ogedengbe intimated the court that the originating process were served on all other 3 deffendents except the 4th deffendents who according to him appeared to be invading service as every effort including phone calls made to serving him yielded no result.
He further explained that the 4th deffendant is one Mr. Garuba Kuamkur who is an Assistant Director in the monitoring and Evaluation Unit of the Development Control, who used his official capacity to instigate officers of the 3rd deffendant to demolish the plaintiffs properties.
