The Kaduna High Court II, presided over by Justice Dogara Malam, on Tuesday adjourned hearing to May 7 in the case instituted by a woman, challenging the demolition of her N17.7 million property.
The adjournment was at the instance of the plaintiff’s lawyer, Mr John Achimugu, who sent in a letter intimating the court of the reasons for his absence, and requested for a new date.
The counsel to the defendants, Mr Sanusi Said, who made appearance for the first time since the case started, did not object to the request by the plaintiff for adjournment.
The woman, Mrs Bathsheba Halid, is protesting the demolition of her property by the Kaduna State Urban Planning and Development Authority (KASUPDA) at Angwan Ma’aji Danhono 1, in Chikun Local Government area in 2013.
The plaintiff is asking the court to declare KASUPDA an illegal entity, saying it is not established by law and therefore its operations and actions are also illegal.
She wants “a declaration that KASUPDA is not established by any of the Laws of Kaduna State and therefore has no statutory existence or powers for the control of the use and development of land in Kaduna State or to demolish the plaintiff’s property in the issue’’..
At Tuesday’s sitting, Justice Dogara Malam adjourned the matter to May 8, for hearing. (NAN)
