Niger: Court vacates COAS, others warrant arrest order

A Federal High Court, sitting in Minna, Nuger State has vacated an earlier warrant of arrest order against the Chief of Army Staff(COAS)General Farouk Yahaya and the Commandant, Training and Doctrine Command Major General Sternson Olugbenga Olabanji.

The vacation order was following motion filed by the counsel to the sixth and seventh defendants, Barrister Piye Yakubu Garuba, seeking the vacation of the earlier order.

Justice Halima Ibrahim Abdulmalik gave the vocation order pursuant of order thirty-nine rules one and two of the Niger State High Court Civil procedure rules 2018 section thirty-six sub one of the 1999 constitution as amended.

In her ruling, Justice Halima held that the order is in view of the compliance with the order of the court made last year which is hereby vacated.

The defence counsel also informed the court that the witness they served to appear be to give evidence in respect of the case was assigned official assignment and pray court for an adjournment on the matter.
