A wife accusing her husband for allegedly infecting her with HIV virus and sued for N40 million damages, yesterday rejected the sum of N2 million damages offered from the accused.
It would be recalled that, Mansur Musa Nyanya, was dragged to Upper Shariah court sitting at Sabon Gari, Kano State, by his wife (name withheld), for allegedly infecting her with the deadly virus, early this year, before the case was transferred to Upper Shariah Court, sitting at Kasuwar Kurmi, Kano, for continuation of the trial.
However, the defense counsel, Aminu Muhammad Usman, offered to enter into reconciliation by both parties during the last proceedings.
But the reconciliation session, held Sunday, and led by the court’s magistrate, Mallam Rabiu Aminu Dausayi, was not successful as the prosecuting counsel rejected the N2million damages, instead of N40million claimed before.
Meanwhile, Barr. Dalhatu, after the magistrate convinced him to accept the offer in order to end the trial, demanded that the accused,who has never appeared before the court throughout the proceedings, should plead guilty of his offence through radio, admit that he is HIV positive and make public apology before they accept the offer.
” They agreed to pay N2million out of the N40million we claimed but the sum is too meager compared to the disease he infected her with. Therefore we prefer to continue with the trial. Or he should admit that he is HIV positive through the radio, and admit that he infected his wife as well as apologise publicly through the media before we agree with their offer.” said the prosecuting counsel
When contacted, the defense counsel, said ” we argue that the plaintiff got married before she married my client and that she didn’t conduct the HIV test before she married him. So I don’t think she was infected by my client. I don’t even believe that she is HIV positive. Let’s the trial continue since they failed to accept our offer.”
Hence, the presiding judge adjourned the case until 16th December, 2014, for continued hearing.
