The Kaduna State Board of Internal Revenue has dragged the management of Ahmadu Bello University, Zaria and Kaduna Polytechnic before North-West Tax Appeal Tribunal, sitting in Kaduna on Wednesday over non-payment of tax liability accrued to the sum of N6,169,774,658.01billion and N3,436,864,461.0 6billion respectively.
The matter which was brought before the Tribunal via a notice of Appeal filed by the Counsel to the Appellant S.A Maisamari dated 16th January, 2014 sought for an order of the Tribunal to compel the two respondents to pay the outstanding tax liabilities.
The notice also gave the grounds of appeal to include that, the respondents have failed to comply with the demand notice served the two appellants, dated 15th November, 2013.
The matter was mentioned at the Tribunal yesterday before Bashir Abdullahi Albasu, Chairman and four other members.
Counsels to the appellant, led by I.M Samson, an Assistant Director in the State Ministry of Justice, presented a motion on notice, seeking an order of extension of time to them file their motion out of time and the second, deeming the originating process in the suit as duly filed and signed.
However, counsels to respondents, M.A Garba and Nathan Dandien for ABU and Kaduna Polytechnic respectively, did not oppose to the motion on notice. The tribunal summarily granted the orders sought for by the appellant in its motion on notice.
The case was however adjourned to 10th September, 2014 for hearing.
