Bauchi govt challenges APC suit on outstanding loan

Bauchi state government has filed a motion on notice in the state high court number 10, presided by Justice Abdulkadir Hussein Suleiman, challenging a suit filed by the Action Progressive Congress (APC), which demanded an explanation on an outstanding government loan.

A member of APC, Musa Idris Hardawa had filed a suit on behalf of the party, claiming that the state government was indebted to some financial institutions to the tune of N8.8 billion and urged the court to compel the state government to explain the N25 billion naira allegedly borrowed.

The counsel to the state government, Sabiu Gumba who filed the motion on notice said that the suit by the APC was incompetent and does not comply with order 7 practice of the court.

Gumba who requested the court to grant the application by the state government, said that the plaintiff lacked the requisite Locus Standi to institute the suit.

He further asked the court to strike out the entire suit for non-compliance with the condition precedent to the exercise of the court jurisdiction.

However, Counsel to APC, Yakubu Bako, who noted that the application by the state government was imperialistic, said that he was not served with the application and asked for adjournment of the case.

According to him, the application was delay tactic by the state government to employ the services of a Senior Advocate of Nigeria, (SAN) in the application.

Justice Abdulkadir Hussein adjourned the case to October 6 2014 for further hearing.
