The Court of Appeal, Tuesday, ordered the stay of execution of the judgement of the federal high court that ordered the deregistration of five political parties.
The Appellate court held that the action of the lower court is an affront on the authority of the court by proceeding on delivering judgement on the matter which it ordered to stay.
The three-man panel of the Appeal court held that the lower court is below bit and duty bond to obey it order.
The appeal court maintained that the Justice Lifu’s action appeared that the lower court is in competition with the superior court.
Recall that Justice Peter Lufu of the federal high court, Monday ordered the Independent National Electoral Commission INEC to deregister five political for failing to meet the constitutional threshold.
The lower court judgement was in disobedience to the order of the Appeal court that ordered it to stay proceeding on the matter pending the hearing and determination of the appeal before it.
