The Supreme Court has dismissed the lawsuit filed by Adamawa State and 10 other states governed by the Peoples Democratic Party (PDP) contesting the declaration of a state of emergency in Rivers State by President Bola Tinubu.
The emergency proclamation, which led to the suspension of elected officials in Rivers State for six months, was challenged by the PDP-led states at the apex court.
In a split decision of six to one delivered on Monday, the Supreme Court struck out the suit, ruling that the plaintiffs failed to establish a valid cause of action to invoke the court’s original jurisdiction.
Delivering the lead judgment, Justice Mohammed Idris held that the 11 states did not demonstrate the existence of any actionable dispute between themselves and the Federation that would warrant the Supreme Court’s intervention under its original jurisdiction.
