The hearing on the suit filed by a former Chief of Army Staff, Lt. Gen. Kenneth Minimah, and two others against Attorney General of Federation and Economic and Financial Crime Commission (EFCC) comes up, June 8.
Justice Inyang Ekwo of the Federal High Court Abuja, fixed the date after all counsel in the matter had admitted having filed and exchanged processes in the criminal charge over alleged diversion of N13 billion meant for procurement of arms.
Plaintiffs alongside Minimah are a one-time Chief of Accounts and Budget of the Nigerian Army, Maj. Gen. A. O. Adetayo, as well as the former Director, Finance and Accounts of the Nigerian Army, Brigadier Gen. R. I. Odi.
Defendants in the suit filed at the Federal High Court are the Attorney General of the Federation and Minister of Justice, and the Economic and Financial Crimes Commission.
At a resumed sitting, Habiba Chime announced appearance for the 1st defendant (AGF) while Buba Mohammed represented the EFCC, 2nd defendant.
The plaintiff’s lawyer, Ufot Okoi informed the court that they have regularized all processes, and served on the respondents.
In a short ruling, Justice Ekwo said,
“My order still remains at any date you are not ready to go on with the matter, I will strike out the charge.
Meanwhile, the court has adjourned to 8, 9, and 10 of June for hearing.’’
