A driver, Muazu Isah has dragged his former employer, Alhaji Ahmad Rufa’i before a Sharia Court sitting in Magajin Gari, Karina North Local Government Area of Kaduna state over unpaid disengagement benefits

Isah who worked with Rufa’I, the  defendant for 10 years as a driver, on a N15,000 monthly salary was disengaged in 2018 after closure of the office.He said no disengagement entitlements were paid to him.

He said he had gone to remind Rufa’i of his benefit after some time but he told him that he doesn’t have any benefit.

Isah added that when he showed Rufa’i his appointment letter, he said it was temporary and that he was not the one who signed it.

The Defendant, Ahmad Rufa’i while responding to Isa’s claim, said section 241 of the Nigerian constitution specified the obligations of the industrial court, noting that the Sharia court doesn’t have jurisdiction over the case.

Rufa’i, through his Counsel, A. I Hamza, prayed the court to dismiss the case, saying it was an employee and organization’s matter.

The Judge, Murtala Nasir, after listening to the defendant, said section 241 of the Nigerian constitution was contrary to what the counsel quoted.

“This is misleading and shameful,” the Judge said.

He adjourned the case to September 19 and ordered the defendant to read the constitution and come up with the right chapter which stated clearly the obligations of the industrial court.
