IGP tenure elongation: Court fixes April 16, for judgment

Justice Ahmed Mohammed of the Federal High Court Abuja, has fixed April 16, for judgement in the suit seeking removal of the Inspector-General of Police, Mohammed Adamu from office.

The court slated the date after parties in the matter had adopted their addresses yesterday.

A legal practitioner, Maxwell Okpara, filed the suit following the decision of President Muhammad Buhari to extend the tenure of Adamu as Inspector-General of Police by three months after his retirement on Feb. 1.

By the suit, the plaintiff wants an order of court for Adamu to resign from office, having spent the mandatory 35 years in service.

President of the Federal Republic of Nigeria is the 1st defendant, IGP Adamu is the 2nd defendant, while the Attorney General of the Federation and Minister of Justice is the 3rd defendant, just as the Nigerian Police Council is 4th defendant in the matter.

At the last adjourned date, Justice Mohammed ordered that originating processes be served on the 4th defendant, who has seven days to reply.

When the matter was called up, yesterday, counsel to the plaintiff, Ugochukwu Ezekiel, and counsel to the 2nd defendants, Alex Izinyon, informed the court that have successfully served the 4th defendant with the originating summon and hearing notice.

Consequently, they informed the court of their readiness to  go ahead with the hearing on the matter slated for the day.

In his argument, the plaintiff adopted their written addresses as written and oral responds to the notice of objection by the 2nd defendant.

‘’We rely on all the affidavit and exhibit attached  and urged the court to grant the reliefs and answer the questions  in favour of the plaintiff,’’

In the same vain, Counsel to the 2nd defendant, Alex Izinyon, urged the court to uphold their preliminary objection in responds to the plaintiff written addresses and dismiss the application.

Counsel to the 1st and 3rd defendant, E. V Elodimuo, also relied on his averments canvased in counter affidavit and written addresses in opposition to the originating summon by the plaintiff.

‘’ We urged the court to discountenance the  arguments and submissions of the plaintiff and give judgment in our favour,’’ he pleaded.

In a short ruling, Justice Ahmed Mohammed, adjourned till April 16 for judgement.
