High Court in Yola, the Adamawa state capital, has commenced hearing of a suit filed by Former Governor Murtala Nyako challenging his impeachment by the state House of Assembly yesterday.
Presiding Judge of the court, Justice Ishaya Banu after hearing the case for mentioned adjourned it to 30th September, for ruling on the abridgement of time to allow for expedited hearing as prayed by counsel to Governor Murtala Nyako, Adeniyi Akintola (SAN) with regards to whether the substituted service of notice of impeachment against Nyako was in order.
Counsel to Nyako noted with concern that since the case started, the third respondent and acting Governor of Adamawa state, Ahmadu Umaru Fintiri has not made appearance despite the fact that the first and second respondents have done so, expressing surprise that since the case was filed the third respondent has not made appearance.
Akintola expressed dismay over the attitude of the Acting Chief Judge of the state who is seemingly trying to frustrate the case adding that since 18th August, they filed the case but the acting CJ refused to assigned it to a vacation judge even after they pleaded with him as he said “we must wait for the court to resume”.
“Even before the court went on vacation, we pleaded that it should be brought before the vacation judge who was on ground but the case was not assigned to her and we have to wait for the court to resume”, he said.
