Suspension: FG files objection to Sanusi’s suit

The move by the ousted CBN governor, Sanusi Lamido Sanusi for an order of court to reinstate him as the governor of the apex bank was yesterday opposed by President Goodluck Jonathan (1st defendant) and the Attorney General of the Federation (2nd defendant).

In a notice of preliminary objection filed on behalf of the 2nd defendant by Chief Mike Ozekhome (SAN), the AGF wants, “An order striking out and/or dismissing this suit for want of competency as this Court lacks the requisite jurisdiction to entertain same.

“That it is in the best interest of justice to dismiss this suit, as granting same would overreach the Defendants and prevent the CBN and the 1st Defendant from carrying out their Constitutional and statutory functions” the AGF added and that it is also in the interest of justice to dismiss the suit as same is self-serving, gold-digging, baseless, provocative, misconceived, and unmeritorious.

The grounds of the application according to the 1st and 2nd respondents were that, “This matter is related to or is connected with labour, employment, and matters arising from work place, the conditions of service, and matters incidental thereto, or connected therewith, over which only the National Industrial Court has exclusive jurisdiction by virtue of Section 254C (1) of the Constitution.

The trial Judge, Justice Gabriel Kolawole in his ruling said both preliminary objection and the originating summon as submitted by Kola Awodein (SAN), counsel to Sanusi would be heard together as opposed by the defendants’ counsels.
