Court frees two charged with armed robbery

Justice Olabisi Akinlade of a Lagos High Court, sitting at Igbosere, recently discharged two men charged with conspiracy and armed robbery.

Akinlade held that the prosecution failed to establish a prima-facie case against them.

The accused: Chukwuji Okoro, 35, and Monday Nwafor, 36, were charged on Oct. 11, 2009 on a two-count charge of conspiracy and armed robbery.

Their Counsel, Mr. O. Ajanaku, had applied that the court should quash the case on the grounds that the prosecution could not establish a prima-facie case against his clients.

Ajanaku said that houses of the accused were searched and nothing that could link them to the alleged crime was found.

According to the charge sheet, the defendants were arrested in August 2009 for conspiracy and armed robbery.

They were alleged to have forcefully dispossessed Mr Charles Ani of a Range Rover Jeep and valuables while armed with a double barrel gun.

The prosecution had said that the offences contravened Sections 402 and 403 of the Criminal Laws of Lagos State, 2011 (NAN)
