State Police Bill: Barau Reveals Key Safeguards Against Political Abuse

In a major legislative push to overhaul Nigeria’s security architecture, the National Assembly and the executive arm of government under President Bola Ahmed Tinubu are working in tight synergy to pass the landmark State Police Establishment Bill.

Speaking on the development, the Deputy Senate President, Senator Barau I. Jibrin, described the executive bill as a product of intense, high-level collaboration among key national stakeholders, designed specifically to address the country’s pressing security challenges.

ADDRESSING THE AGITATIONS FOR LOCALIZED POLICING

According to the Deputy Senate President, the move comes in response to prolonged and intensified agitations from various quarters across the country demanding a reform of the current centralized security architecture.

“We are a country operating under democracy, and we must listen to the people,” Senator Barau stated, noting that previous constitutional review exercises in the 9th Senate faced similar demands. However, the current momentum reflects a broader consensus that Nigeria needs to inject new strategies into its security apparatus to boost efficiency.

To ensure all voices were heard, the National Assembly conducted extensive public hearings across all geopolitical zones, engaging state governments, civil society organizations, and private individuals in a fully transparent and televised process.

ROBUST SAFEGUARDS AGAINST ABUSE OF POWER

Addressing widespread public concern that state governors might weaponize state police services to persecute political opponents or abuse human rights, the Deputy Senate President assured that the bill contains stringent constitutional safeguards.

Unlike state electoral commissions, which critics argue are tightly controlled by local politicians, the state police will operate under a strict National Minimum Standard of Operation enshrined by the National Assembly.

KEY INSTITUTIONAL SAFEGUARDS IN THE PROPOSED LEGISLATION INCLUDE:

APPOINTMENT CHECK: The Commander of the State Police shall be appointed by the State Governor, but only upon the strict recommendation of the National Police Council.

The National Police Council Composition: This regulatory body will maintain strict professionalism, comprising the President, State Governors, the Inspector-General of Police (IGP), and retired high-ranking police experts. This setup effectively prevents any single individual from exercising total authority over the state force.

Federal Intervention Power: In the event that a state police service derails, compromises national sovereignty, or acts in a manner inimical to the Federation, the President retains the constitutional power to invoke relevant sections to disable that service and authorize the Federal Police to take over operations immediately.

CLEAR JURISDICTIONS AND ENDING INTER-AGENCY RIVALRY

The bill explicitly demarcates operational boundaries between federal and state policing to prevent friction and intelligence gaps.

The Federal Police will strictly handle federal and interstate matters, organized crime, cybercrime, and offences with international dimensions.

The State Police Services will be solely tasked with maintaining law and order locally, protecting lives and property within their respective states, in strict compliance with laws that do not conflict with the Constitution or Acts of the National Assembly.

Senator Barau emphasized that the greatest strength of state policing lies in deploying personnel who understand the local terrain, culture, and language.

“When you engage those who are part of that same society—those who know every nook and cranny of their community—they will work harder and more effectively,” he said, citing crisis-prone areas like Zamfara State as examples where local officers could easily track down bandits and bring them to justice.

TIMELINES FOR IMPLEMENTATION

With the Senate having made significant progress on the bill, the legislation is expected to move swiftly through the House of Representatives before being transmitted to the State Houses of Assembly for their constitutional concurrence.

Once the constitutional alterations are finalized, the National Assembly will pass subsequent Acts to address the finer details, including the funding mechanisms for the new state police services.

“There is strong political will from President Tinubu and an equal passion from the legislature. No stone will be left unturned to ensure these innovations smoothly repair our security architecture,” Senator Barau concluded.
