The Federal High Court in Abuja on Thursday invalidated the leadership of the African Democratic Congress (ADC) led by Senator David Mark, in a ruling that also affects the presidential candidacy of former Vice-President Atiku Abubakar.
The court found merit in a suit filed by Nafiu Bala Gombe, the aggrieved former National Deputy Chairman (North-East) of the party.
Gombe had approached the court to challenge the process through which the Senator Mark-led committee assumed control of the party’s leadership.
In his judgment, Justice Peter Lifu declared the Senator Mark-led ADC Caretaker Committee illegal. The committee had organised the party’s primary election that produced Atiku Abubakar as its presidential candidate.
The plaintiff had argued that following the resignation of the former National Chairman, Chief Ralph Nwosu, he was constitutionally entitled to assume the party’s leadership.
Consequently, Gombe asked the court, among other reliefs, to nullify all actions taken on behalf of the party by the Senator Mark-led leadership.
