Court frees woman charged for homicide in Bauchi

Bauchi state high court number seven has discharged and acquitted a woman, Azumi Abubakar accused of allegedly stabbing a lady, Aisha Yunusa with knife and burnt her to death.

The presiding Judge, Justice Aliyu Baba Usman in his judgment said, “The accused was charged with criminal conspiracy and culpable homicide, punishable with death in line with section 96, 97 and 221 of the Penal Code Law.

Justice Aliyu, said the case was a criminal case which must be proved beyond reasonable doubt, but the prosecutor failed to prove their case, since the only witness they called failed to link her with the murder of the deceased.

He said the witness said he has not seen when the accused stabbed the deceased with knife to death, for that the prosecutor failed to prove their case beyond reasonable doubt.

Justice Aliyu said “I hereby hold that the prosecution failed to prove their case of culpable homicide, punishable with death against the accused and hereby discharged and acquitted her of all the offences”

Azumi was arraigned by the counsel from the state ministry of Justice by prosecution counsel, Barrister Garba Abdullahi , when the case was earlier mentioned, the accused has no money to defend herself and Barrister Idris Jibo offered to serve as counsel to the accused free of charge, under the community rescue Initiative, on governmental organisation..

The accused was earlier arraigned on the allegations that she had criminally conspired and killed Aisha Yunusa, burnt her and abandoned the corpse in the farm of one Abubakar Alias Mai Harawa.

The prosecution alleged that Azumi caused the death of Aisha by stabbing her with knife near her nose and burnt her to death.
