A Grade 1 Area court in Aso Pada, Mararaba, has discharged a house wife, Ejiura Abdul, accused of assaulting a police officer, for want of diligent prosecution.
Abdul, 23, of Calvary Road, Ruga village, was arraigned on December 23, 2013.
The judge, Mr. Albert Maga, discharged the accused at the resumed hearing after the prosecution told the court that the complainant “had been sick and the IPO is on leave’’.
Maga said that: “since the mention of this case in December 2013 the prosecution is yet to produce any witness.
“This case has suffered several adjournments at the instance of the prosecution.
“I, therefore, invoke Section 165 of the Criminal Procedure Code (CPC). The accused is hereby discharged. The case is struck out.”
Prosecutor Friday Ada had told the court that on December 18, Constable Bala Maiguna, was assigned to invite one Abdul Adamu, the husband of the accused.
He said: “When the accused was questioned on the whereabouts of her husband, she became violent and assaulted the police officer, damaged his shoe and injured him on his elbow.’’
The accused, who is also a hair stylist, had pleaded not guilty to the charge against her. (NAN)
