Court remands 2 for culpable homicide, conspiracy

A Lokoja Chief Magistrate Court has remanded a 21-year-old welder and Okada rider, Tope Joshua and Sesan Osagbemi, 19, Tiller in prison custody for allegedly stabbing one Moses Michael to death with a knife.

Magistrate Levi Animoku of Lokoja Chief Magistrate Court 1, issued the order in his ruling on the allegations of Criminal Conspiracy and Culpable Homicide, contrary to sections 97(1) and 221 of the Penal Code Law preferred against the duo, Tuesday, in Lokoja.

The prosecuting police officer, Mr. Tuesday Ganagana said that the accused committed the alleged offences on June 30, at about 7:30 am at Makuku, Isanlu in Yagba-East Local Government of Kogi.

He said that one Samuel Moses, a cousin of the deceased reported the matter at the Divisional Police Headquarters, Isanlu at about 8:30 am same day.

He added that Tope Joshua aka Adeola of Itedo-Ijowa in Isanlu, Sesan Osagbemi aka “Snake”, Timber Dealer of Itedo-Amuro, Isanlu and one Akon of same address conspired and committed the offence.

They were alleged to have stabbed the late Michael “on his left chest and died while receiving treatment at a hospital as a result of the injury he sustained from the cut.

Prosecutor Ganagana said that, while Akon was lynched by a yet-to-be-identified mob at Isanlu, investigation led to the arrest of Joshua and Osagbemi.

Animoku, in his ruling, said the offence of culpable homicide was the highest known crime to our laws, adding: “Section 341(1) of the CPC forbids a court of this type from admitting to bail a person accused of such offence.”

He therefore refused the application and ordered that both accused be remanded at Federal Prisons, Kabba.

Animoku transferred the case to Chief Magistrate Court, Kabba and adjourned to November 27 for mention at Kabba.
