A Federal High Court sitting in Gusau, Zamfara state capital has stroke out suit against Governor Bello Mohammed Matawalle over his defection to the All Progressives Congress (APC) as both political parties as well as the 1999 Constitution of the federal republic of Nigeria did not in any way prohibit the action.

The court presided over by Justice Bappa Aliyu, stressed that there has not been any provision in the constitutions of APC and PDP which made it unlawful for Governor Bello Matawalle to decide and defect to any other constitutionally recognized political party operating within Nigeria.

Also passing the judgment, Justice Bappa pointed out that the case was neither a pre-election nor post-election matter which would have been an Elections Petitions Tribunal case, saying the Federal High Court lacks jurisdiction to handle it.
