President Muhammadu Buhari, has been dragged before the Federal High court, Abuja, over the appointment and confirmation of Muheeda Farida Dankaka and Muhammed Bello Tukur as Chairman and Secretary of Federation Character Commission respectively.
Other defendants in the suit are Attorney General of the Federation, Federal Character Commission. Muheeda Farida Dankaka and Barr. Mohammed Bello Tukur
The Plaintiff, Barr. Festus Oluwasanmi Onifade, in the suit marked FHC/ABJ/709/2021, wants the court to declare that appointment and confirmation of Dankaka and Tukur by the Senate is a violation of the Constitution and therefore unlawful, unconstitutional, null and void for not in compliance with the law.
The suit was premised on order 3 rule 6, 7 and 9 of the federal high court.
In the charge sheet, the Plaintiff wants the court to determine, if the appointment and continuous holding of office by the 4th and 5th respondents as Chairman and Secretary of the Federal Character Commission is not inconsistent with the provisions.
After determining the relief sought above, the Plaintiff wants the court to declare that President Buhari and the Senate are bound to observe and comply with the provisions of the sections 7 ond 8 (1)(2) (a) (b) (c) of the Constitution as amended, in the appointment of persons to the office of the Chairman and Secretary of Federal Character Commission.
He also prayed the court to declare that the appointment and confirmation of the 4th and 5th respondents by the President and the Senate of the National Assembly into the office is inconsistent with the law and so renders their continuous stay in office unlawful, unconstitutional.
Also in the suit, the plaintiff wants the court to declare that President Buhari and the Senate are bound to observe and comply with the provisions of the sections 7 and 8 (1)(2) (a) (b) (c) of the Constitution as amended, in the appointment of persons to the office of the Chairman and Secretary of Federal Character Commission.
Consequently, the Plaintiff prayed the court for an order directing Buhari to immediately dissolve and reconstitute the board of the 3 and 4 Respondent to reflect Sections 4(1} of the Subsidiary Legislation.
He want the court to order the chairman and secretary of the Federal Character Commission to immediately vacate office forth with.
Equally, he also wants an order of the court directing president Buhari to immediately appoint other persons into offices of Chairman and Secretary of the commission in compliance with the law.
In an affidavit in support of the originating summon deposed to, by the Plaintiff, he maintained that the actions of the 1 and 3 respondents have generated complaints and ill feelings from persons and interest groups from the southern parts of the country.
In his submissions, he posited that he know as a fact that interest groups from the south East and South West Nigeria protested and called on the Senate of the National Assembly to refuse the confirmation of Dankaka as the Chairman of the Commission.
No date has been fixed for the hearing of the matter.
