Justice Binta Murtala- Nyako of the federal high court, Abuja, has granted leave to the Incorporated Trustees of Conference of Civil Society for Transparency and Accountability to apply for Judicial Review under the Freedom of Information Act.
The court, in an ex-parte motion, granted the applicant leave for an order of mandamus to compel the defendants to furnish it with the copies of documents, records and information as requested in the Freedom of Information demand letter dated 14″ April 2026, marked as “Exhibit B”.
The court ordered that the Respondents, Lee Engineering and Construction Company Limited and Attorney General of the Federation(AGF) in motion dated 14th May and filed on the 15th May, 2026, be put on notice.
In the suit marked FHC/ABJ/CS/889/2026, the Plantiff is seeking the following reliefs:
An order granting leave to the Applicant to apply for an Order of Mandamus compelling the AGF to perform his statutory duties under the Freedom of Information Act 2011, particularly in respect of monitoring, enforcing and ensuring compliance with the provision of the Act.
The motion was supported by an affidavit sworn to by Odje Onlede, of 14 Theba Tseka Street, off Adetokunbo Ademola Street, Wuse 2, FCT, Abuja together with Written Address, Exhibits and a further Affidavit and filed at the Registry of the court.
The suit followed an FOI request dated April 14, 2026, through which CCSTA sought access to documents relating to several oil and gas projects executed by Lee Engineering for the Nigerian National Petroleum Company (NNPC) Limited and its subsidiaries.
According to the applicant, the request include documents relating to Warri refinery rehabilitation contracts, the Utorogu Gas Plant expansion, the Assa North-Ohaji South (ANOH) gas project, emergency pipeline repairs, environmental impact assessments, host community development expenditures, procurement approvals and compliance with local content requirements.
The court has adjourned the case to 26 September 2026 for mention.
