The Supreme Court, Friday, upheld the elections of the governors Duoye Diri of Bayelsa State, Usman Ododo of Kogi State and Hope Uzodimma of Imo state in the November 11 off-cycle elections in the respective states.
Apex court, had in a unanimous judgment by a five-man panel of judges, dismissed all the appeals for lacking merit.
On appeal filed by Timipriye Sylvia against Diri and All Progressive Congress(APC), the five-man panel of the supreme court lead by Justice Lawal Garba, the court affirmed the lower court decision of 15 July, that declared Sylva’s appeal an abuse of court process for filing two notices of appeal.
Citing a section of the section 246(1) of the 1999 Constitution, the Apex Court panel held that the APC Governorship candidate has only one right to appeal the judgment of the Tribunal and not multiple.
In the same vain, the court upheld the election of governor Usman Ododo of the All Progressives Congress(APC) by affirming the decision of the appellate court of 27 May, in his favor.
Our correspondent reports that by the judgement, the Apex court dismissed the appeal of Murtala Ajaka, candidate of the Social Democratic Party SDP contesting the outcome of the off cycle poll.
Specifically, the five-man panel of the Apex Court held the allegation of substantial non-compliance with the Electoral Act was not proven by the SDP governorship candidate.
Also, the judgement added that allegations of age falsification and certificate forgery are pre-election matters, which it has jurisdiction to hear.
Meanwhile, the court also dismissed the two separate appeals brought to Court by the Labour Party (LP) and the People’s Democratic Party (PDP) against the declaration of Hope Uzodinma as the elected governor of Imo state.
The appeals of the LP governorship candidate, Athan Achonu and that of PDP Samuel Anyawu were rejected for wants of merit.
In the lead judgment delivered by Mohammed Baba Idris, the LP and PDP gubernatorial candidates were said to have failed to establish allegations of over voting and other malpractices against the November 11,2023 poll.
The unanimous decisions of the apex court upheld the earlier decisions of the Court of Appeal and that of Imo State Governorship Election Petition, which sat in Abuja and dismissed the petitions in their separate judgements.
