The Executive National President of Road Transport Employers Association of Nigeria, Comrade Eriyo Osakpamwan has filed a notice of preliminary objection before the National Industrial Court.
The preliminary objection which was filed by the RTEAN President lead Counsel, Barrister Olayiwola Afolabi dated 16th October, 2019 and filed same day granted an interim order restraining Musa Mohammed and 6 others.
The interim order as granted by the NICN also restrained Musa Mohammed with their servants and agents from further parading themselves as the officers of Road Transport Employers Association of Nigeria.
“That while the suit is still pending and the interim Orders still subsists, the said Musa Mohammed and other defendants in suit number NICN/ABJ/275/2019 gathered the named claimants herein and declared himself the acting National President and Henry Ejiofor as the General Secretary of the 1st claimant.
“That it is this action which was carried out in contempt of the Orders this honourable court that the claimants herein field this suit to enforce.
“That the 1st claimant having obtained the Orders restraining the named defendants in suit number NICN/ABJ/275/2019 and their agents (2nd to 35th claimants herein) for parading themselves as its officers cannot turn around and filed this present suit asserting the opposite.
“That the 2nd to 35 the claimants have no authority and consent of National Executive Council to file this suit with the name of the 1st claimant.
“That suit number NICN/ABJ/275/2019 which was filed before the present suit still subsists and the interim orders granted therein are still subsisting”
Meanwhile, the court on Thursday 17th, October, 2019 asked both parties to maintain peace pending the determination of the case.
The court adjourned till 13th of November, or 16th of December, 2019 should in case the court couldn’t sit on the first date.
