Chief J-K. Gadzama, SAN, has commenced proceedings at the Federal High Court challenging the decision and directions of the Legal Practitioners Disciplinary Committee, with the court granting him leave to pursue judicial review.
The proceedings, filed following the LPDC decision concerning him, raise questions over the legality of the disciplinary process, constitutional safeguards and the availability of an effective appellate mechanism for challenging disciplinary decisions.
Gadzama is asking the Federal High Court to examine the decision under its supervisory jurisdiction.
At the centre of the application is whether a disciplinary decision can be effectively enforced where the affected legal practitioner has no operational avenue to appeal the merits or legality of the decision.
The application also relies on the legal implications of recent judicial decisions, including the Supreme Court judgment in the case of Ben Mene-Ejegi, concerning the route for challenging decisions of the disciplinary body.
According to the application, the present legal position creates a situation where a disciplinary decision may have serious professional consequences without an effective appellate mechanism for review.
Gadzama contends that the situation raises issues of access to justice, fair hearing, natural justice and the rule of law.
The application further challenges aspects of the procedure adopted by the LPDC in reaching its findings.
Among the issues before the court are the evaluation of evidence, procedural fairness, notice, reliance on collateral judicial observations and allegations which Gadzama argues were not independently established during the disciplinary proceedings.
The underlying dispute, according to the application, involved legal practitioners and issues relating to representation, retainership and professional fees.
Gadzama’s case is that the matter did not involve an allegation that he defrauded or harmed a client.
He also argues that documentary evidence supporting his position was not properly evaluated and that certain conclusions were reached without adequate scrutiny and proof.
The proceedings therefore place both the specific disciplinary decision and wider questions concerning the exercise of professional disciplinary powers before the Federal High Court.
Lawyers have described the judicial review application as an opportunity for the court to examine whether disciplinary proceedings carrying serious professional consequences comply with constitutional and procedural safeguards.
The Federal High Court’s grant of leave allows Gadzama to proceed with the judicial review application while preserving his right to practise as a Senior Advocate of Nigeria.
Among the reliefs sought are orders concerning the legality of the LPDC decision and directions, the findings made against him and the constitutional validity of enforcing disciplinary sanctions where there is no effective appellate mechanism.
The application also seeks consideration of an effective mechanism through which disciplinary decisions can be subjected to judicial or appellate review.
Gadzama said he remained committed to the judicial process and would pursue the matter through lawful means.
He maintained that the issues arising from the LPDC decision were matters for judicial determination and should be examined in accordance with the Constitution, principles of natural justice and the rule of law.
