Assault case on blind woman transferred to magistrate court

A case of alleged assault on visually impaired woman, Malama Sadiya Muhammad Halliru, has been transferred to Chief Magistrate court.

At the last adjourned date, counsel to the defendant, contended that Senior Magistrate Lukman Sidi of Magistrate Court Tudun Wada Zaria, lacked jurisdiction to hear the case.

Consequently, Sidi recuse himself from the matter and transfer it back to the Chief Magistrate Court 1 Chediya for reassigning.

The defendant is alleging trespassing, use of force, and assaulting a physically challenged woman which is contrary to sections 327,237, and 239 of the penal code law of Kaduna State 2017.

Recalled that on the 6th of September 2024, Mallam Garba Adda’ a resident of Gonar Ganye Tudun Jukun Zaria, made a complaint at Tudun Wada Police Command, that one khadi Mahmoud Shehu locked up the main gate to his house, followed his wife who is blind into her room and beat her up alongside two other ladies trying to defend her.

According to him, the unnecessary adjournment of the defense attorney caused the delay of hearing Prosecutor Adamu Abubakar.

When the matter was called, the prosecuting officer, told the Court that the case is slated for a definite hearing.

He drew the attention of the Court of its order for the defendant to pay witnesses the sum of N20.000 for their transportation expenses due to unnecessary adjournments caused by the defense.

Sadiya, a woman with a strong desire to serve her community as a nurse, has suffered not only physically but emotionally, and her dreams are now in jeopardy due to this attack.

The incident has sent shockwaves through the community, sparking widespread condemnation from rights groups and advocates for persons with disabilities (PWDs) of the molestation of a blind housewife.
