Court discharges driver of trespass

A Grade 1 Area court in Aso Pada, Mararaba, has discharged a driver, Repheal Abakpa, 28, of criminal conspiracy for want of diligent prosecution.

The presiding judge, Mr. Albert Maga, discharged the accused after prosecution said that the complainant was not in court and the investing police officer was on casual leave.

He prayed the court to adjourn the matter to enable him to bring his witnesses to court.

Maga refused the prosecution’s request, invoked section 165 of the Criminal Procedure Code (CPC), struck out the matter and discharged the accused person for want of diligent prosecution.

The accused was first arraigned on April 25 on a count charge of criminal trespass.

On that same date, the prosecutor, PC Friday Adaji, told the court that the matter was reported at the Aso Pada Police Station by one Christian Ekwe of Aso Pada on April 25.

Adaji said that on that same date at about 3.20 a.m., the accused entered into Ekwe’s room without his consent before he was arrested.

The accused pleaded not guilty to the charge. (NAN)
