Court discharges minor accused of theft

Life Camp Senior Magistrates’ court has dischargeda 15-year-old minor, of Jabi, DakiBiyu, Abuja, charged with receiving stolen property valued N120, 000.

The Magistrate, Abdullahi Abolaji, who struck out the case of theft the minor, for want of jurisdiction, explained that going by the provisions of the Child Rights Act, the court lacked jurisdiction to entertain any suit against minors.

He therefore struck out the First Information Report (FIR) and transferred the case to Family court in Wuse Zone 2, Abuja.

“By provisions of the Child’s Rights Act, the case should be taken to a family court adequately provided by the FCT judiciary of the High court and Magistrate court level,’’ he held.

Prosecutor Simon Emmanuel had told the court that one Sgt. Esisolgho Emyobosan of Nigeria Airforce Kado Estate, Abuja, reported the case at the Life Camp Police Station on July 21.

Emmanuel said the accused was apprehended at the building site of the complainant in Kado Estate, Abuja, with a pick-up loaded with his wood valued at N120,000.

He said that during police investigation the wood was recovered from the accused.

“During interrogation, the accused claimed that he bought the wood from one Amos Larpalagh, the security guard of the site for N14,000,’’ the prosecutor said. (NAN)
