Jigawa court convicts 50-year-old rapist to 10 years imprisonment

Justice Muhammad El-Usman of Jigawa State High Court sitting in Ringim, has sentenced 50 year old Abubakar Biniya to 10 years imprisonment for raping an 11-year-old girl.

The convict of Galadanchi Quarters, Ringim committed the offence in January, 2024.

The prosecution led six witnesses and tendered five exhibits including the medical report in support of their case, while the convict testified in his defence and called no witness.

While delivering judgment on the case, Justice Muhammad El-Usman said the court was convinced beyond reasonable doubt, but took into consideration the convict’s plea for leniency and the fact that he was a first offender, in arriving at the verdict.

In addition to the 10 years imprisonment, the court ordered the convict to pay a compensation of Five Hudred Thousand Naira to the victim.

The court also ordered that the name of the convict be published in the Jigawa State Sexual Offenders Register by the state Ministry of Justice.

It also ordered for the public shaming of the convict through radio announcement, in line with the provisions of Section 3 (2), (4) and (5) of the Violence Against Persons Prohibition (VAPP) Law, No. 2, 2021.

The parties were given three months within which to appeal the judgment.

Meanwhile, the court has discharged one Sale Kurma, 55, of Tsinaho Village, Taura LGA, who was charged with the offence of rape.

The court also discharged one Mansur Ahmed, 22, of Tsira Village, Ringim LGA, also for the offence of rape.

The court also in a separate judgment, discharged one Haruna Ahmadu, of Marawa Village, Ringim LGA, charged with the offences of criminal conspiracy and robbery.

All the three defendants were discharged for the failure of the prosecution to establish the charges made against them.
