Court discharges vagrant for irregularities in FIR

A Chief Magistrates’ court in Mararaba, has discharged a vagrant, Isaac Abraham, of criminal charges, for irregularities on the part of the prosecution.

Abraham, 21, was charged with one count of being a vagabond, which contravened the Penal code.

Delivering ruling, Senior Magistrate Habila Abundaga, said contrary to information provided by the prosecutor, the accused had a place to stay before he was arrested.

“As evident here in the First Information Report (FIR), the accused has a place he was living in before he was arrested,’’ he said.

Abundaga said the FIR also did not show that the accused committed any offence to warrant being punished.

He said it was not fair to continue to let the accused keep coming to court to answer to an offence he never committed in the beginning.

Abudaga, therefore struck out the case and discharged the accused.

Earlier, the prosecutor, Mr. Stephen Kwaza, had told the court that Mr. Duru Clif of Angwan Hashimu, Mararaba, reported the matter at Sani Abacha Police Station on May 31.

Kwaza said the accused was seen wandering around the complainant’s business premises and when questioned, he was unable to give a satisfactory answer.

According to the prosecutor, during the course of police investigation, it was discovered that the accused was a vagabond and had no means of livelihood. (NAN)
