An Edo State High court, sitting at Okada on Wednesday, reserved hearing on motion to restrain defendants involved in Obazuwa Community land dispute.
The Claimant is Prince Edun Akenzua, the Duke (Enogie) of Obazuwa Community while Pa Rowland Oyemwense and seven others are the first set of Defendants in the case.
Justice A. T Momodu held that the the Interim motion ex parte — an order before the commencement of hearing of the case will be held on the 11th Day of May 2022.
The ex parte interlocutory application motion which was filed by the Claimant, was earlier slated for Wednesday March 9, 2022.
Fielding questions from newsman on Wednesday, the Counsel to Defendants, Matthew Edaghese Esq., recalled that the interim injunction granted by the court on the 13th December 2021, ceased to subsist after 14 days.
According to him, the injunction which had earlier set aside the leadership structure in Obazuwa, had since elapse, alleging that the Claimant in the suit has resorted to self help and despicable act of illegality, is unacceptable.
“We have since exchanged pleadings. Before we came to court, they (Claimants) said that they have an interim injunction granted them by this court dated 13th December 2021.”
